These Terms of Service ("Terms") are the agreement between you and Second Nature Co ("Second Nature," "we," "us," or "our") when you visit our website, place an order, or use our products. By using the site or placing an order, you agree to these Terms. If you do not agree, please do not use the site.

1. Who can buy from us

To order from Second Nature you need to be at least 18 years old and a resident of the United States with a U.S. shipping address. If you are buying as a gift, you agree to these Terms on your own behalf and are responsible for passing along the product information, including the label, to the person receiving it.

2. Orders, pricing, and payment

When you place an order through our website, you are making an offer to buy at the listed price. Your order is accepted when we send a confirmation email. We may cancel or refuse an order for reasons including suspected fraud, pricing or listing errors, or stock issues. If we cancel your order, we refund you in full.

Prices are in U.S. dollars. Taxes and any shipping charge are shown at checkout before you pay. If a price is listed in error, we may cancel the order and notify you.

When you submit a review, photo, video, or any other content to Second Nature, whether on our site, by email, or by tagging us on social media, you give us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with our business. You confirm the content is yours and does not violate anyone else's rights. We may remove any content at our discretion.

6. Our intellectual property

The Second Nature name, logo, product design, photography, copy, video content, and the overall look and feel of our website and packaging are owned by Second Nature Co or licensed to us. They are protected by copyright, trademark, and other intellectual property laws. You may not use them without our written permission.

7. Acceptable use

You agree not to misuse the site, interfere with its operation, attempt to access accounts or data that are not yours, scrape content at scale, or use the site for anything unlawful. We may refuse service and cancel orders if you do.

EXCEPT AS EXPRESSLY STATED IN OUR REFUND POLICY, AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SECOND NATURE CO MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, ABOUT THE SITE OR THE PRODUCTS, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SECOND NATURE CO AND ITS OFFICERS, EMPLOYEES, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE ORDER GIVING RISE TO THE CLAIM. SOME STATES DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.

You agree to defend, indemnify, and hold harmless Second Nature Co and its officers, employees, and agents from any claim, loss, liability, or expense, including reasonable attorneys' fees, arising out of your breach of these Terms, your misuse of the website or any product, or your use of the product contrary to its label or medical advice you have received.

11. Disputes

These Terms are governed by the laws of the State of California, without regard to conflict of law rules.

Step 1: Talk to us first. Before either of us files anything formal, we both agree to try to work it out informally for at least 60 days. Send a written notice describing the issue and what you would like us to do to the address below.

Step 2: Binding arbitration. If the informal period does not resolve things, either of us may elect to resolve the dispute by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, on an individual basis only. You and Second Nature each waive the right to bring or participate in a class action. Either of us may instead bring an individual claim in small claims court.

Opt-out. You may opt out of the arbitration provisions by sending us written notice within 30 days of your first purchase, with your name, order number, and a clear statement that you are opting out.

12. Changes to these Terms

We may update these Terms from time to time. The version posted on the site applies to your order at the time you place it. If we make material changes, we will update the date at the top of this page.
